is there still a copyright problem i don't know about that's keeping them there? they seem to be all 20th century pieces

This is because they are Copyright in the U.S. - they are all publications after 1922.

can IMSLP get in trouble for that?

i've always thought that warnings were enough to withstand any legal assault (it works for videogame emulator sites at least)

We like to err on the safe side. Plus, that exact reason is why we had to close down for 6 months, October 2007-June 2008

Emulator sites don't host content that is copyrighted anywhere, except to the developers of the emulators (who want the programs to be distributed). If you mean ROM sites, well those are illegal and shouldn't be compared to IMSLP at all.
