Non-PD USness, Digital Millennium Copyright Act

Post by coulonnus »

I recently uploaded this score:http://imslp.org/wiki/Violin_Sonata_No. ... dot,_Paul) and its copyright status is Non-PD US. Yet the Sibley corresponding page https://urresearch.rochester.edu/instit ... emId=29722 says "Digital images made available during the final 20 years of US copyright in accordance with the Digital Millennium Copyright Act". Shouldn't there exist an intermediate copyright status between Non-PD US and PD US for such a case?

I think this was discussed already here somehow.

Yes but this one was Non-PD worldwide and the corresponding work page cannot exist. :-)

Viardot died in 1941 and is free everywhere except the USA (and maybe France, with its odd wartime extension). It is not free in the USA (assuming a renewal) but it is certainly free in Canada. Sibley has it due to the section 108 exemption for publicly funded libraries.

6-month belated comment about this- one thing the PD-everywhere-but-US thing does mean though is that if one's in the US one should not only not be downloading it but also not uploading it, either (obviously :) )
